What we need
hfgphotography Ltd will be the ‘Controller’ of the personal data you provide to us. We collect basic personal data about you including name, address, email, and telephone number.
Why we collect your data
We need your basic personal data in order to provide you with information about photography services in accordance with our contract. We will not collect any personal data from you that we do not need in order to provide and oversee this service to you.
What we do with your data
All the personal data we hold is processed by myself in the UK however for the purposes of IT hosting and maintenance this information is located on encrypted servers within the European Union.
All Images are stored on encrypted hard drives in a locked safe.
No 3rd parties have access to your personal data unless the law or our contract with you, allows them to do so.
We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.
What we would also like to do with your data
We would like to use your name and email address to inform you of our exclusive future offers and similar products. This information is not shared with third parties and you can unsubscribe at any time via phone, email or our website.
How long we keep your data
We keep your images for the length of time agreed upon in our contract with you, after which time they will be deleted. Your information we use for marketing purposes will be kept with us until you notify us that you no longer wish to receive this information.
What are your rights?
If at any point you believe the information we process on you is incorrect you can request to see this information and have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact Holly Gormanly at holly@hfgphotography.co.uk who will investigate the matter.
If you are not satisfied with our response or believe we are not processing your personal data in accordance with the law you can complain to the Information Commissioner’s Office (ICO).Ltd
T&C'S
Applicable Law
The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
Deposit
A minimum deposit is due upfront at the time of booking to secure the booking. The deposit is none refundable. The Full balance of the shoot is due 1 week before the time of the booking.
If you need to re-arrange your session, a minimum of 48 hours notice is required, after this time a new deposit will be required to re-book. All re-arranged shoots must be agreed within 30 days.
Rescheduling - In the event a booking needs to be reschedueled, the new date must be agreed within the next 30 days. Post the 30 day period an additional booking fee will be required.
Lateness/No Show - Please arrive 5 minutes prior to your scheduled photoshoot time. If you arrive after your allotted time, this time is deducted from your session. hfgphotography Ltd is not required to extend your session due to lateness and is entitled to cancel the photoshoot if you arrive over 20 minutes late to your allocated time. If you find yourself late due to unforeseen circumstances please advise via telephone prior to your session start time.
Viewing
hfgphotography Ltd will aim to show the client a gallery of 30 fully edited images however there is no guarantee that any particular number of proofs will be produced. Proofs will be available for your viewing 2 weeks post session unless stated upfront otherwise - this time frame can increase during busy periods but you will be notified of this at the time of shooting. hfgphotography Ltd is not obligated to provide the client with any images that are not already presented to them. For all orders, payment is due in full at time of order. No orders are made unless they are fully paid for. Physical orders must be placed within 1 year of purchase, after this time frame cost increase will be incurred.
Digital Orders
The USB is a method of delivering the files to you and isn't intended as permanent storage. It is solely Client's responsibility to back up the images and make enough copies for the images to be stored safely. hfgphotography Ltd will not be held responsible for loss of images due to failure to care for USB or misplacement and loss of USB.
hfgphotography Ltd can only guarantee that when the USB leaves the studio it is in perfect working order and expect any technical issues to be addressed to hfgphotography Ltd within 48 hours.
hfgphotography Ltd cannot be held liable for image variation looking a different colour, crop etc when printed elsewhere. When prints and products are ordered from hfgphotography Ltd we provided the highest quality print on professional paper and high quality products ordered from a lab with colours calibrated to the photographer's screen, and images are presented at their best.
Fulfilment of Obligation
hfgphotography Ltd shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. In the unlikely event of total photographic failure or cancellation of the contract by hfgphotography Ltd liability shall be limited to a full refund of all monies paid.
Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.
If Client fails to read the supplied messaged with preparatory information, and therefore fails to carry out required preparations prior the session, hfgphotography Ltd will not be held responsible for any resulting reductions in quality or quantity of images supplied.
Artistic Input
hfgphotography Ltd shall be entitled to use judgement regarding the style and artistic input in the production of pictures. This includes but is not limited to poses, props and number of images taken. Due to the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, hfgphotography Ltd may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.
Images are fully edited before presenting to Client. Additional edits requested by client after viewing their photos are carried out at the discretion of hfgphotography Ltd, and hfgphotography Ltd reserves the right to charge the Client £25 per image for additional editing to cover time involved.
Copyright and Reproduction
hfgphotography Ltd is and shall always remain the copyright holder. No image can be copied, scanned or reproduced in any form whatsoever without permission of hfgphotography Ltd. The Client may not alter or add to or manipulate a picture by any means or reproduce a picture without written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by hfgphotography Ltd only when digital images are purchased and paid in full by the Client to hfgphotography Ltd. A print release form (printing rights) will be supplied with the client's digital images when purchasing a USB of the digital images from hfgphotography Ltd.
In the event of unauthorised reproduction the Client shall pay by way of liquidated damages to hfgphotography Ltd an unauthorised use fee of £100 per image, or double the standard reproduction fee for the use concerned, whichever is the greater.
Use of Photography
hfgphotography Ltd requires written permission to use the images for social media and all means of advertising, this will be discussed in contract upon booking. Should consent not be given, hfgphotography Ltd will not use the images for business purposes (advertising, samples, social media, competition) but the images will be stored by the business, solely for the client and not personal use by the photographer.
Data Storage
By paying a deposit you are entering in to this contract, the client agrees for hfgphotography Ltd to store their data (including but not limited to home address and e-mail address) on paper in the client's order forms and in the online encrypted client management system. This data will not be used in any way that doesn't comply with the data protection laws. It is solely for the photographer to use in order to contact the client when needed. The data will not be used for marketing purposes unless the client physically opts in for e-mail/postal advertising and marketing.
The client agrees for the photographer to store their images on the photographer's computer, any external hard drives and online back up storage systems including but not limited to live drive.
Cooling off Period
All bespoke products are none refundable. Orders cannot be cancelled due to the custom nature of the products. All orders have a 24 hour cooling off period (excludes USB digital images when taken from the studio at the time of paying).
Returns Policy
Incorrectly supplied items can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error by the Client. Digital images are none returnable / refundable due to the nature of the product.
Vouchers
Vouchers can only be purchased against full priced items, these cannot be used in conjunction with any other offers / Mini shoots. Vouchers are not redeemable for cash. All vouchers have a one year expiry.
Deletion of Images
All images are stored for 4 weeks after the date of your shoot and will be deleted after this time frame if no viewing has taken place. Images are kept for 2 weeks post viewing, if no order has been placed in this time frame images will be deleted. If a gallery requires re-activation a £25 admin fee will be applied. Purchased images are stored for 12 months after date of purchase. All non-purchased images are deleted after you have made your order.
Photography and Video By Client
Cameras, mobile phone cameras and camcorders are not permitted during any session to take photos or video of the set up and/or the child on their own.
By paying a deposit you are agreeing to the above terms & conditions.
IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE UNDER THE LAW, THE VALIDITY OF THIS AGREEMENT AS A WHOLE SHALL NOT BE AFFECTED, AND THE OTHER PROVISIONS OF THE AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.
